Accessing Claiborne Parish Bankruptcy Records

The main way to search Claiborne Parish bankruptcy records is through PACER, the federal court system's Public Access to Court Electronic Records portal. PACER gives online access to case dockets and filed documents for every federal court in the country, including the Western District of Louisiana. Create a free PACER account at pacer.uscourts.gov.

Use the PACER Case Locator to search by debtor name, case number, or the last four digits of a Social Security number. You can filter by court and date range. Each page you view costs $0.10, with a $3.00 cap per document. If your total quarterly usage stays under $30, PACER waives the fee entirely. Many researchers who do only occasional lookups pay nothing.

The McVCIS phone system offers a quick alternative for basic case lookups without a PACER login. Call 1-866-222-8029, which is toll-free and available around the clock, every day of the year. You can check up to five cases per call and hear back the case status, chapter type, and filing date. It's a useful quick check when you just need to confirm whether someone has filed or whether a case is still open.

For in-person access, visit the Shreveport courthouse at 300 Fannin Street. Public access terminals connected to PACER are available in the clerk's office at no charge. Court staff can help you locate cases and navigate the system. Certified copies of documents cost $11 each and can be ordered at the clerk's counter.

Filing Fees and Costs in Claiborne Parish

Filing fees for federal bankruptcy cases are set by Congress under 28 U.S.C. § 1930. They are uniform across all districts and divisions. For Claiborne Parish cases filed in Shreveport, the fees are: Chapter 7 at $338, Chapter 13 at $313, Chapter 11 at $1,738, and Chapter 12 at $278. These are due at the time of filing and must be paid by cash, money order, or cashier's check. Personal checks are not accepted.

Chapter 7 filers whose income falls at or below 150% of the federal poverty level can apply to waive the filing fee entirely. Others can request to pay in installments over up to 120 days in up to four payments. For Chapter 13, 11, and 12 filers, installment arrangements are available with court approval, but full waivers are not an option under those chapters. The fee waiver application form is available on the court's website or from the Shreveport clerk's office.

PACER record access costs $0.10 per page ($3.00 maximum per document). Certified copies are $11.00 each. Plain photocopies are $0.50 per page. A formal records search conducted by court staff costs $32.00.

What Claiborne Parish Bankruptcy Records Contain

Under 11 U.S.C. § 107, all papers filed in a bankruptcy case are public records open to inspection unless sealed by the court. The typical Claiborne Parish case file includes the petition showing the debtor's name, address, chapter type, and filing date; schedules of assets and liabilities; a statement of financial affairs; the creditor matrix with all creditor names and addresses; income and expense forms; any proposed repayment plan (for Chapter 13 filers); and the discharge order at the close of a successful case.

Federal Rule of Bankruptcy Procedure 9037 requires specific redactions from public filings. Social Security numbers may only appear as the last four digits. Full birthdates must be reduced to the year only. Financial account numbers show just the last four digits. The full names of minor children are not allowed; only initials can appear in public documents. Attorneys who fail to redact these identifiers can face sanctions from the court.

Sealed records exist in certain business cases involving trade secrets, sensitive personal data, or ongoing law enforcement matters. Accessing sealed documents requires a formal motion to the court with a showing of good cause. For most consumer cases, the full docket is publicly available through PACER with no additional steps required.

Louisiana's eClerks system, established under La. R.S. 13:754 and launched in 2015, gives online access to civil court records from participating Louisiana parish clerks. It does not include federal bankruptcy records, but it can be a useful tool for finding related state court documents such as civil judgments or mortgage liens for Claiborne Parish. Search eClerks at www.eclerksla.com.

The Louisiana Legislature's official statutes are available at www.legis.la.gov. Louisiana's property exemption laws under La. R.S. 13:3881 are particularly relevant to bankruptcy filers. Louisiana does not allow the use of federal exemptions, so state law controls what a debtor can protect from creditors. This includes the homestead exemption, vehicle exemption, tools of the trade, and certain life insurance and retirement values. These exemptions directly affect what a Chapter 7 trustee can liquidate and what a debtor walks away with after the case.

The Louisiana State Bar Association's Lawyer Referral Service can connect you with a licensed bankruptcy attorney.
